Assignment: Prosecutorial Roles

In choosing what charges to file when a crime is committed, a prosecutor wields significant power. That power is checked by specific evidentiary requirements—for example, a prosecutor could not charge someone with drug trafficking if that person was simply found possessing a small amount of heroin for personal use. Still, a single prosecutorial decision can mean the difference between a 3-year and a life sentence, a plea bargain and a trial, or a conviction and a mistrial.

For this Assignment, you assume the role of a prosecutor involved in several criminal cases.

To prepare:

  • Read the Week 4 case studies found in the Criminal Justice Case Studies: Criminal Law, Week 4 document.
  • This Assignment requires you to apply your learning to all case studies in the document.

By Day 7 of Week 4

Write a 750- to 1,000-word paper that addresses the following for each case study:

  • What decision would you make as the prosecutor for each of the three cases? Be sure to address the following:
    • What is the actus reus, level of mens rea (purposeful, knowing, reckless, or negligent), and is there concurrence?
    • As the prosecutor, would you bring charges against the suspect or would you drop the charges?
    • If you decide to charge a suspect or suspects, be sure to address the following: What would you charge them with and why? Would you consider offering a plea agreement? What sentence would you recommend?
    • If you decide not to charge a suspect or suspects, explain how you came to this conclusion.

Discussion: Power in the Criminal Justice System

The branches of the criminal justice system work together to maintain a civil society. Enforcing laws, charging and trying offenders, and dictating punishment must coexist to safeguard the public. Without any one of them, the system would crumble.

But if you were to look at each branch of the criminal justice system individually, which one would hold the greatest power? For this Discussion, you share your perspective on power in the criminal justice system.

Assignment: Choosing a Career in the Judicial System

Lawyers make money—or so says one common opinion in society. While the law may offer a high earning potential, there are other reasons to practice law (and less lucrative areas of it). Consider that another word for lawyer is advocate, and to advocate means to represent and work for the interests of another. Whether that means advocating for the collective good of citizens (i.e., the government) or to ensure that every person in the judicial system receives representation (i.e., the defense), working in the judicial system in numerous areas can be a vocation, motivated by a desire to serve the public.

In this Assignment, you imagine that you have been called to deliver a presentation at a nearby law school in which you discuss the standards, ethics, and merits of a career in the judicial system.

By Day 7

Submit a Kaltura video of delivering a presentation that follows the guidelines below. Your video should be no longer than 5 minutes.

You have been called to deliver a presentation at a nearby law school. Your goal is to enlist new law students into working within the district attorney’s office or as public defenders after graduation. Your presentation must address the following:

  • How can each position—district attorney or defense attorney—be viewed as more than just a job or a stepping stone?
  • How is each position valuable to the community?
  • Why and how is each position necessary?
  • What makes each position effective?
  • What makes each position different?
  • What are the positive and negative aspects of each position?
  • How does each position depend on each other for the system to function? How do they work together despite the adversarial relationship?

Follow these tips for delivering a professional presentation:

  • Dress professionally and conduct yourself as if you are in a professional setting with peers and supervisors.
  • Be sure to maintain eye contact as if you were speaking in front of your audience.
  • Finally, be sure to record yourself in a room that is quiet and where no one interrupts you.

Discussion: Ethics, Accountability, and Citizen Roles

Recall a recent election ballot: Did you know the names or positions of the judges on it? Did many of them run unopposed?

Citizens elect judges and district attorneys. Those individuals have political party affiliations and run on specific platforms, and thus are answerable to the electorate. Meanwhile, defense attorneys for offenders with less means are often appointed, having no prior relationship or knowledge with a client. Imagine being the accused in a complicated case and feeling like your constitutionally guaranteed advocate may seem to be “punching a ticket” with your case. Now, imagine that you are a citizen called to jury duty. Or imagine that you were witness to a crime but refuse to testify. What is your motivation for engaging with the judicial system?

In this Discussion, you examine the role of ethical conduct from many perspectives, including the one perspective everyone shares, even if they work in the criminal justice system: the citizen.

Choose one topic from the list below and write a 10 – 14-page research paper examining the effects of domestic violence on that community.  Before selecting a topic, I strongly recommend that you conduct some initial research to ensure that you’re satisfied with the pool of literature that currently exists.  For instance, you may be interested in writing about the impact of domestic violence on the transgender community but, after a preliminary search, you may determine that the existing literature is too scarce for your liking (but it is out there!).  

You may also select a topic not on the list below, and you are more than welcome to choose a topic that is narrower in focus.  For example, rather than writing about the South Asian community, you might be more interested in writing about domestic violence in the Bangladeshi community.

Your paper should focus on five key areas:

  • An introduction to the general problem of domestic violence
  • A literature review on domestic violence in the community you selected (e.g., prevalence, belief systems, cultural constructs, etc.)
  • An assessment of how local, state and federal laws currently address or fail to address domestic violence in the community you chose
  • A review of systems’ response to domestic violence in that community (e.g., the response of police, health care workers and human services professionals; in other words, what is being done in terms of prevention, intervention and services?)
  • A scholarly analysis wherein you tie each of the above sections together and summarize your findings. Your findings should focus on the key points of your research and be complemented by corresponding recommendations to better addresses domestic violence in the community you selected.

Your paper must cite at least nine (9) scholarly articles from a peer-reviewed journal or other credible source; there is no maximum number of references you can include.  Please note that at least five (5) of these articles must be cited in your paper’s literature review.  Sections 1 and 4 above should include the remaining citations and any other citations that you choose to incorporate.
